Historical Background The creation of the state highway system shortly after the turn of the century prompted numerous actions to be brought before the courts as private properties were sought for highway development and improvements. The documents generated as part of the action were filed in the Office of County Clerk as Clerk of the Courts under series designation "Highway Papers." Although the series "appears" to have been abandoned into the second decade of the 20th century, with an ending date of 1925, only the filing procedure was actually changed. All court actions brought forth after 1917, regardless of type, were assigned unique, sequential case numbers in chronological order, and docketed in the Civil Action Register beginning with case 1, 1917. Thus, all subsequent highway actions can be found in the series entitled: "Civil Actions." The practice of filing by case number continues to this day.
Description of Record Series Documents, previously tri-folded, unfolded and refoldered using acid-free folders and mylar housing for maps, and including but not limited to: affidavits, correspondence, petitions, testimony, exhibits (maps (blueprints, vellum, pencil drawings and photographs)), orders and final judgment; provides court and filing date information. Plank Road documentation constitutes 1 folder (1848-1853); Miscellaneous - 2 folders/Items # 1-20. Sidepath Commission - 1 folder (1901). OCA Schedule # 20070
Purpose of Record A record of proceedings brought before the court pertaining to the acquisition private property for the purposes of highway development and improvement; including miscellaneous, Plank Road and Sidepath Commission documentation.
